Refund and Returns Policy

Terms of Sale

The following terms and conditions (the “Terms”) govern the purchase of products and services through www.smartid.ai and www.track.ai (together, the “Sites”). By placing an order, you (“Customer” or “You”) agree to these Terms. If you do not agree, do not place an order on the Sites.


Definitions

  • Products: Refers to hardware (e.g., SmartID devices) and software licenses available for purchase on the Sites.
  • Services: Refers to support, maintenance, or other services offered in connection with the Products.
  • Track AI: Refers to Track AI, Inc., the owner and operator of the Sites.

Orders

  • Order Acceptance: Orders are subject to acceptance by Track AI. Receipt of an order confirmation does not signify acceptance, and Track AI reserves the right to cancel or refuse orders at its discretion.
  • Accuracy: You are responsible for ensuring the accuracy of all order details, including product specifications, quantities, and delivery addresses.

Pricing and Payment

  • Pricing: All prices are listed in USD and are subject to change without notice. Applicable taxes, shipping, and handling fees will be added during checkout.
  • Payment: Full payment is required at the time of purchase. We accept payment via [Insert Payment Methods].
  • Taxes: Customers are responsible for all applicable taxes, including sales, use, or VAT, based on their location.

Shipping and Delivery

  • Shipping Terms: Shipping costs and estimated delivery times will be displayed at checkout. Delivery dates are estimates and not guaranteed.
  • Ownership and Risk: Ownership and risk of loss pass to the Customer upon delivery of the Products to the carrier.

Returns and Refunds

  • Return Policy: Products may be returned within 30 days of receipt if they are unused, in original packaging, and accompanied by proof of purchase. Software licenses are non-refundable.
  • Refunds: Refunds will be processed within 10 business days after the returned item is received and inspected. Shipping costs are non-refundable.
  • Restocking Fee: A 15% restocking fee may apply to returned hardware.

Software Licenses

  • License Terms: Software licenses purchased through the Sites are subject to the terms of the applicable End User License Agreement (EULA).
  • Non-Transferable: Licenses are non-transferable and valid only for the specified term.
  • Renewals: Customers are responsible for renewing licenses to avoid interruptions in service.

Warranty

  • Hardware Warranty: Track AI provides a 1-year limited warranty for hardware against defects in materials and workmanship. The warranty does not cover damage caused by misuse, modifications, or external factors.
  • Software Warranty: Software is provided “as is” without warranties of any kind, unless explicitly stated in the EULA.
  • Warranty Claims: To make a warranty claim, contact info@track.ai with proof of purchase and details of the defect.

Limitation of Liability

To the fullest extent permitted by law:

  • Track AI’s liability for any claim related to Products or Services is limited to the amount paid by the Customer for the applicable Product or Service.
  • Track AI is not liable for indirect, incidental, or consequential damages, including loss of profits or data.

Governing Law

These Terms are governed by the laws of the State of Minnesota, without regard to its conflict of laws principles. Any disputes arising from these Terms will be resolved exclusively in the courts located in Hennepin County, Minnesota.


10. Changes to Terms

Track AI reserves the right to update or modify these Terms at any time. Changes will be effective upon posting on the Sites. Continued purchases following any updates constitute acceptance of the revised Terms.
